Many mainstream journalists and writers are getting rather over excited by the recent results of a case between the Recording Industry Artists of America (RIAA) and Lime Wire, the filesharing giant. The RIAA came out top in Judge Kimba Wood’s initial decision, and it appears that LimeWire has had its wrists firmly slapped. It should be remembered though that this is just a preliminary decision, and has a long way to go yet. Also it should be remembered that filesharing ‘giants’ in the past have been brought down, only to pave the way for other services.
Think of the original ‘giant’ of the space: Napster. It’s legal battles – which it lost – just made future filesharing entrepreneurs think a little bit outside the box. The dead wood was lost and a new, better, way of approaching the filesharing issue was borne. Services that we now consider to be ‘old timers’ – Ares and of course LimeWire – rose like Phoenixes out of the ashes to dominate the new market. If LimeWire is taken down by this move, then no doubt the industry will move onwards and upwards again. Ares and its brethren are always, it seems, two steps ahead of the game.
